1. What is the EB-2 National Interest Waiver?
 

The EB-2 National Interest Waiver is an employment-based immigrant pathway for professionals who qualify through an advanced degree or exceptional ability. Where USCIS grants the National Interest Waiver, the applicant may self-petition without permanent employer sponsorship or PERM labor certification. 

2. Can I apply for EB-2 NIW without a U.S. job offer?

Yes. An EB-2 NIW applicant may request that USCIS waive the usual job-offer and labor-certification requirements because the proposed endeavor would benefit the national interest of the United States. However, the applicant must still qualify for the underlying EB-2 classification. 

3. Who can qualify for an EB-2 NIW?

An applicant must first qualify as either an advanced-degree professional or a person of exceptional ability in the sciences, arts or business. The applicant must then demonstrate that the proposed U.S. endeavor satisfies the three National Interest Waiver requirements. 

4. Can a bachelor’s degree holder qualify for EB-2 NIW?

Possibly. A bachelor’s degree or its foreign equivalent, followed by at least five years of progressive post-degree experience in the relevant profession, may be treated as the equivalent of an advanced degree for EB-2 purposes. Eligibility still depends on the proposed endeavor and the strength of the overall evidence. 

5. What does “exceptional ability” mean for EB-2 NIW?

Exceptional ability means expertise significantly above that ordinarily encountered in the sciences, arts or business. Evidence may include academic qualifications, extensive professional experience, licences, remuneration, professional memberships, recognition and significant achievements. 

6. What are the three EB-2 NIW requirements?

The applicant must demonstrate that:

1. The proposed endeavor has substantial merit and national importance.

2. The applicant is well positioned to advance the proposed endeavor.

3. On balance, it would benefit the United States to waive the job-offer and labor-certification requirements. 

7. What is a proposed endeavor?

A proposed endeavor explains the professional work the applicant intends to advance in the United States, the problem or opportunity it addresses, its broader significance and how the applicant plans to implement it. USCIS evaluates the specific proposed endeavor rather than relying only on the general importance of the applicant’s profession or industry. 

8. Which professions may qualify for EB-2 NIW?

EB-2 NIW is not restricted to a fixed list of occupations. Engineers, healthcare professionals, researchers, academics, IT and cybersecurity specialists, data and AI professionals, energy experts, finance professionals, entrepreneurs and other qualified individuals may be eligible. However, occupation alone is not sufficient; USCIS evaluates the individual’s qualifications, proposed endeavor and supporting evidence.

9. Is IELTS required for EB-2 NIW?

No specific IELTS or English-language test is required for an EB-2 NIW petition. However, applicants must still demonstrate that they possess the qualifications, experience and ability required to advance their proposed endeavor.

10. Is an investment required for EB-2 NIW?

No minimum investment is required. EB-2 NIW is based on professional qualifications, exceptional ability, the proposed endeavor and its significance to the United States. It is different from investment-based immigration categories.

11. Can my spouse and children accompany me?

A qualifying spouse and unmarried children under 21 may generally apply as derivative immigrant visa applicants with the principal applicant, subject to visa availability, documentation and individual admissibility requirements. 

12. What are the government fees for an EB-2 NIW petition?

For an individual EB-2 NIW self-petitioner, the current Form I-140 filing fee is US$715, together with the reduced US$300 Asylum Program Fee, making the standard USCIS petition-stage payment US$1,015. Additional charges may later apply for immigrant visa processing, medical examinations, civil documents, translations and other services. Government fees may change and should be reconfirmed before filing. 

13. Is premium processing available for EB-2 NIW?

Yes. Premium processing is available for EB-2 NIW petitions. For requests filed on or after March 1, 2026, the premium-processing fee for the relevant Form I-140 classification is US$2,965. USCIS provides premium-processing action within 45 business days. That action may be an approval, denial, Request for Evidence or another formal action; premium processing does not guarantee approval. 

14. How long does the complete EB-2 NIW process take?

The total timeline varies according to USCIS processing, whether premium processing is selected, any Request for Evidence, visa-number availability, National Visa Center processing and embassy interview scheduling. An I-140 approval does not automatically mean that an immigrant visa or Green Card is immediately available. Applicants must also monitor the applicable Visa Bulletin. 

15. What happens after the I-140 petition is approved?

Applicants outside the United States generally proceed through the National Visa Center and consular processing once their priority date is eligible. They must complete the required immigrant visa application, submit civil documents, undergo a medical examination and attend an interview at the relevant U.S. embassy or consulate. Eligible applicants already in the United States may pursue adjustment of status where legally permitted. 

16. Can applicants from Pakistan apply for EB-2 NIW?
